The Texas Responsible AI Governance Act Is Already in Effect. Here's What It Requires.
TRAIGA took effect January 1, 2026. If your business uses AI tools in Texas, you have new legal obligations around discrimination, biometrics, and disclosure.

Texas passed an AI law, and it’s already in effect. The Texas Responsible AI Governance Act (TRAIGA) became law on January 1, 2026, creating legal obligations for any business deploying AI systems in the state. If your company uses Copilot, ChatGPT, AI-powered hiring tools, or automated decision-making systems, TRAIGA applies to you.
Most Texas businesses missed this entirely. The law passed with minimal press coverage compared to flashier AI regulation in Colorado and Europe. But four months in, the compliance requirements are real, and the enforcement infrastructure is being built out right now.
What TRAIGA Actually Says
TRAIGA takes a different approach than the prescriptive frameworks you may have read about from other states. Rather than requiring extensive pre-deployment documentation for every AI tool, it focuses on three core obligations.
Prohibition on AI-driven discrimination. You cannot deploy an AI system with intent to discriminate based on protected characteristics, and you cannot maintain a system you know is producing discriminatory outcomes. This goes beyond hiring. If you use AI for customer service decisions, loan processing, insurance underwriting, or any scenario where outcomes differ by race, gender, age, or disability status, TRAIGA creates legal exposure.
The law builds on the existing Texas Data Privacy and Security Act (TDPSA), which already governs how personal data is processed. Penalties under TDPSA reach up to $7,500 per record, per violation. TRAIGA does not create a separate penalty structure but instead creates new grounds for enforcement under existing consumer protection statutes.
Biometric data rules for AI training. If your AI systems use biometric identifiers (fingerprints, facial recognition, voiceprints, gait patterns), TRAIGA requires explicit disclosure and consent before that data is used for AI model training or inference. This catches businesses using biometric timekeeping systems, facial recognition for building access, and voice-based authentication tools that feed data into AI models.
Government disclosure requirements. Any AI system used in government-facing transactions or public-sector contracting must disclose that AI is involved in the decision-making process. If you sell to Texas state agencies or local governments and use AI in any part of your service delivery, you need disclosure language in your contracts and customer communications.
The AI Advisory Council and Regulatory Sandbox
TRAIGA doesn’t just set rules. It creates enforcement infrastructure.
The law established a 15-member AI Advisory Council responsible for recommending additional legislative reforms, monitoring AI-related harm, and advising the Governor’s office on emerging risks. The council includes representatives from industry, academia, civil rights organizations, and state agencies. Their recommendations will shape future enforcement priorities and potential legislative updates in the 2027 session.
Texas also launched a regulatory sandbox program that allows businesses to test AI systems under lighter compliance requirements in exchange for increased transparency and reporting. The sandbox is designed to encourage innovation while collecting real-world data on AI risks. Participation is voluntary but requires application and ongoing reporting to the advisory council.
The practical implication: Texas is building the apparatus for stronger AI enforcement. TRAIGA is the foundation, not the ceiling.
How TRAIGA Compares to Colorado and the EU
Understanding where Texas sits relative to other AI laws helps you plan for what’s coming.
Colorado’s AI Act (SB 205) took effect February 1, 2026, and is significantly more prescriptive than TRAIGA. Colorado requires algorithmic impact assessments for any AI system making “consequential decisions” (hiring, lending, insurance, healthcare, housing). Businesses must document how AI systems work, what data they consume, how they test for bias, and must provide opt-out mechanisms for affected consumers. Violations carry penalties up to $7,500 per incident under the Colorado Consumer Protection Act. If your business has customers in Colorado, you’re already subject to these requirements regardless of your headquarters location.
The EU AI Act enters full enforcement in August 2026. It categorizes AI systems by risk level (unacceptable, high-risk, limited, minimal) and imposes requirements proportional to risk. High-risk AI systems (used in employment, credit scoring, education, law enforcement, critical infrastructure) require conformity assessments, human oversight, and detailed technical documentation. Fines reach up to 35 million euros or 7% of global annual turnover. If your business has EU customers or employees, the August deadline applies to you.

The direction is clear across all three frameworks: AI regulation is becoming more specific, more prescriptive, and harder to ignore. TRAIGA is currently the lightest of the three, but the advisory council exists specifically to recommend tightening it.
Who This Applies To
TRAIGA applies to any business that deploys AI systems in Texas. “Deploy” is defined broadly. If you purchased an AI-powered tool and your employees use it in their work, you’re deploying AI. You don’t need to be building models from scratch.
Common AI deployments that trigger TRAIGA obligations:
- Microsoft Copilot in Microsoft 365 (summarizing emails, drafting documents, analyzing data)
- ChatGPT or Claude used by employees for research, writing, or analysis
- AI-powered hiring tools that screen resumes, score candidates, or schedule interviews
- Customer service chatbots that make decisions about account access, billing, or service eligibility
- Automated underwriting or credit tools that evaluate risk or pricing
- Biometric access systems that use facial recognition or fingerprint scanning
If any of those sound like your business, you have compliance obligations under TRAIGA. The most common gap we see is businesses that adopted Copilot or ChatGPT for productivity without realizing they’ve entered a regulated category.
Your TRAIGA Compliance Checklist
Here’s what to do this quarter. None of this requires a lawyer on retainer or a six-figure consulting engagement.
1. Inventory every AI tool in your organization. Survey every department. Include tools employees adopted on their own without IT approval. Check network traffic for connections to known AI services (OpenAI, Microsoft AI endpoints, Google AI, Anthropic). If you’ve already completed an AI data governance review, start with that inventory and update it.
2. Identify which tools make decisions about people. Flag any AI system that influences hiring, customer outcomes, access decisions, pricing, or eligibility determinations. These are your highest-risk deployments under TRAIGA and every other AI law.
3. Check your biometric data usage. Review whether any of your systems collect fingerprints, facial geometry, voiceprints, or other biometric identifiers, and whether that data feeds into AI processing. If it does, verify that you have proper consent documentation in place.
4. Review AI-powered hiring and HR tools for bias. Contact your vendors and ask for documentation on how their AI models are tested for discriminatory outcomes. Request bias audit reports. If vendors can’t provide them, that’s a red flag worth escalating.
5. Create a written AI use policy. Document which tools are approved, what data can be entered into them, what decisions require human review, and who is accountable for AI governance. We covered how to build an AI policy that satisfies multi-state requirements in a recent post.
6. Add disclosure language to government contracts. If you sell to Texas state or local government agencies and any part of your service delivery involves AI, update your contracts and proposals with appropriate disclosure language.
7. Assign an AI governance owner. Someone at your company needs to own this. It doesn’t have to be a full-time role, but it can’t be nobody. This person monitors regulatory changes, maintains your AI inventory, and ensures new tools go through a compliance review before deployment. Your AI services provider can support this function if you don’t have internal capacity.
What Happens If You Do Nothing
TRAIGA enforcement will likely be complaint-driven in its early phase. The advisory council is still forming its recommendations, and no enforcement actions have been publicized yet. But waiting for the first enforcement action to take compliance seriously is the same logic that left businesses scrambling after TDPSA enforcement began.
The more practical risk is litigation. TRAIGA creates new grounds for discrimination claims tied to AI deployment. If an applicant, customer, or employee experiences a discriminatory outcome from one of your AI systems and you have no documentation showing you took reasonable steps to prevent it, your legal position is weak.
Getting ahead of compliance now costs a fraction of responding to an enforcement action or discrimination lawsuit later. The businesses that documented their AI governance in Q1 2026 will be in a fundamentally different position than those still waiting.
